Overview

Citizenship revocation is one of the most serious legal actions the Australian government can take against a citizen. If you are facing revocation proceedings, you need immediate legal representation. The grounds for revocation include fraud or misrepresentation in the citizenship application, certain criminal convictions, and national security concerns. I provide urgent defence representation to protect your Australian citizenship.

Verify all deadlines independentlyThe citizenship revocation defence deadlines and time limits referenced on this page are general guidance only and may not reflect your specific circumstances. Appeal periods and response deadlines vary depending on the visa type, the basis of the decision, and how and when the decision was notified to you. Always check your decision letter for the exact deadline that applies to your case and seek independent legal advice before relying on any date. Getting a deadline wrong can permanently affect your appeal rights.

The Australian Citizenship Act 2007 provides several grounds for revoking citizenship. Section 34 allows revocation where citizenship was obtained by fraud or misrepresentation. Section 35 deals with automatic cessation of citizenship for dual citizens who serve in the armed forces of a country at war with Australia. Section 36 allows the Minister to revoke citizenship on character grounds in certain circumstances.

Revocation proceedings are extremely serious and can result in the loss of all rights associated with Australian citizenship, including the right to live and work in Australia, the right to vote, and the right to an Australian passport. If your citizenship is revoked, you may be placed on a bridging visa and face removal from Australia.

Common questions about

Can the government take away my Australian citizenship?+
Yes, in certain circumstances. The most common ground is where citizenship was obtained by fraud or misrepresentation. The government can also revoke citizenship on character grounds or national security grounds in limited circumstances. You have the right to be heard before any revocation decision is made.
What happens if my citizenship is revoked?+
If your citizenship is revoked, you lose all rights associated with Australian citizenship. You may be placed on a visa (such as a bridging visa) and could face removal from Australia. You would need to apply for a visa to remain in Australia.
